Terms of Service

1. Service provider

This service is provided by Petit Restauració S.L. (hereinafter “SayMail”, “we” or “the Company”), with Tax ID B64903495 and registered address at C/ Riera Nº 10, 08393 Caldes d'Estrac, Barcelona, Spain. Contact: toni@motormont-ai.com.

2. Description of the service

SayMail is a SaaS (Software as a Service) application that enables users to convert voice notes into professional sales emails using artificial intelligence. The service includes:

  • Audio-to-text transcription.
  • AI-assisted email generation with various copywriting techniques.
  • Integration with Google Drive for storage and Google Calendar for scheduling.
  • Generated email history.

3. Acceptance of terms

By registering or using SayMail, you agree to these Terms of Service, our Privacy Policy and our Cookie Policy. If you do not agree with any of these terms, you must not use the service.

4. Account and registration

  • To use SayMail you need a Google account. You sign in via Google Sign-In.
  • You are responsible for maintaining the security of your Google account.
  • You must not share your access or allow third parties to use your account.
  • You must be at least 18 years old or have the consent of a legal guardian.

5. Plans and pricing

SayMail offers different subscription plans with tiered features:

  • Starter (€27/month): basic email generation features.
  • Pro (€87/month): advanced features including product catalog and company context.
  • Brain (€427/month): all features, multiple profiles and premium integrations.

Prices include VAT where applicable. We reserve the right to change prices with 30 days' prior notice. Payments are processed through Stripe, a PCI-DSS certified payment processor.

6. Free trial and cancellation

  • SayMail may offer free trial periods at its discretion.
  • You may cancel your subscription at any time through your Stripe dashboard.
  • Cancellation takes effect at the end of the current billing period.
  • No refunds are given for partially consumed billing periods.

7. Acceptable use

You agree NOT to use SayMail to:

  • Send spam, unsolicited bulk emails or fraudulent content.
  • Generate illegal, defamatory, threatening or offensive content.
  • Impersonate third parties.
  • Attempt to access other users' accounts or data.
  • Reverse-engineer, decompile or copy the software.
  • Deliberately overload servers or carry out attacks.

Violation of these terms may result in suspension or cancellation of your account without refund.

8. AI-generated content

Emails generated by SayMail are created using artificial intelligence and are advisory in nature. It is important that you understand:

  • Generated content is a suggestion that you must review before sending.
  • You are solely responsible for the content you send to your recipients.
  • SayMail does not guarantee the accuracy, suitability or commercial effectiveness of generated content.
  • We are not liable for commercial results arising from the use of generated emails.

9. Google integrations

SayMail integrates with Google services (Drive and Calendar) to provide additional functionality:

  • Google Drive: stores copies of your generated emails in your own Drive account, in an “SayMail_Log” folder. The files belong to you and remain in your Drive.
  • Google Calendar: allows you to create reminder events to schedule email sends.

You can revoke these permissions at any time from your Google account settings. SayMail only accesses files it creates within Drive (drive.file scope) and does not read or modify other files in your account.

10. Intellectual property

  • The SayMail brand, design, code and application technology are the property of Petit Restauració S.L.
  • Emails generated from your voice content belong to you.
  • We do not claim any rights over content you generate with the tool.

11. Data protection

Personal data processing is governed by our Privacy Policy. In particular:

  • Voice recordings are processed for transcription and deleted after generation.
  • Technical data (preferences, settings) is stored locally in your browser.
  • We use providers such as OpenAI (for AI), Resend (for email delivery) and Google (for Drive/Calendar), always under appropriate contractual safeguards.

12. Limitation of liability

To the maximum extent permitted by law:

  • SayMail is provided “as is” and “as available”.
  • We do not guarantee uninterrupted or error-free service.
  • Our maximum liability is limited to the amount you have paid for the service in the last 12 months.
  • We are not liable for indirect damages, loss of profits or data loss.

13. Changes to the service and terms

We reserve the right to modify these Terms of Service. We will notify you of material changes by email or via a notice in the application at least 15 days in advance. Continued use of the service after notification constitutes acceptance of the new terms.

14. Account deletion

You may request account deletion at any time by sending an email to toni@motormont-ai.com with the subject “SayMail account deletion request”. More information on our cancellation page.

15. Governing law and jurisdiction

These terms are governed by Spanish law. Any disputes shall be submitted to the courts of the consumer's domicile, in accordance with applicable consumer protection legislation.
